  • We are Specialised Physio at Home and below are the terms and conditions on which Specialised Physio at Home provides physiotherapy treatments ('the Services'). We offer our Services within the comfort of your home or workplace and we thank you for choosing us.

  • Our Terms and Conditions (“Terms”) constitute a legal binding agreement between Specialised Physio at Home (“SP”, “We”, “Us” or “Our”).

  • SP acts as a booking service for the provision of the Services that are performed in each and every case by self employed independent physiotherapists contracting on a self employed basis (“Independent Physiotherapists”). SP acts as an agent for the Independent Therapists and provides the booking service so we are not liable for any Services you receive from the Independent Therapists which are booked through Us. It is the Independent Therapist who is legally responsible for providing the Services to you. The Services you receive from our Independent Therapist will be subject to their individual contract and you will be asked to confirm your acceptance of such prior to receiving the Services.

  •  We provide the booking service and also ancillary services relating to customer service. We remain your point of contact for bookings, cancellations, refunds and the like.

  • The nature of the Services provided will depend on what is agreed and the result of the Initial Assessment (see clause 1 below). You will be assigned an appropriately qualified Independent Physiotherapist to conduct the Initial Assessment and the Services on behalf of Us.

  • We may modify our Terms at any time and our fees may also change from time to time. We may also terminate, suspend or change any aspect of our booking service at any time and for any reason.

  • Please do not make a booking through Us if you do not agree to our Terms. If you have questions please do not hesitate to contact us.

  1. Initial Assessment

1.1 Purpose of the Initial Assessment

Prior to the provision of Services We require that you and the Independent Physiotherapist go through an assessment ('the Initial Assessment'). The Initial Assessment consists of 2 parts:

1.1.1       An assessment of various health indicators: the Independent Physiotherapist will carry out an assessment including a physical examination of you in order to determine the treatment that is necessary. This information will be captured in an Initial Assessment Form.

1.1.2       Development of a treatment programme: Based on the results of clauses 1.1.1 you and the Independent Physiotherapist will discuss the type of condition and symptoms you have and discuss a treatment programme. You and the Independent Physiotherapist may also need to discuss and agree an exercise programme, as well as things you can do yourself to help with the treatment provided. After you agree on the treatment programme the Independent Physiotherapist will add this information to the Initial Assessment Form.

1.2         Length of Initial Assessment and cost

The Initial Assessment normally takes 60-90 minutes. The fee for this is agreed with the manager of Specialised Physio at Home. The fee is payable to Us as set out on the SP website www.specialisedphysio.com and the fee for the Initial Assessment is non-refundable should further Services not be recommended or taken.

1.3         Further points

Please note that after the Initial Assessment has been carried out, the Independent Physiotherapist may decide that they cannot provide any Services. For example, you may suffer from a medical condition which the Independent Physiotherapist cannot treat, or you may need to obtain help or treatment from another medical practitioner or undergo further tests (which We cannot provide). If this is the case the Independent Physiotherapist will suggest what you need to do next. You should then communicate the outcome of the Initial Assessment and the Independent Physiotherapist’s recommendations to your medical practitioner. 

1.4         Your Responsibilities

You must provide complete and accurate information at the time of booking through Us and during your Initial Consultation. Failure to do so may result in a rejection of your booking request or the inability of your Independent Physiotherapist to provide Services as requested.

2. Performance of the Services

Where the Services to be performed involve treatment the Independent Physiotherapist will normally provide you with the Services: only after an Initial Assessment is carried out; and in accordance with the programme of treatment agreed.

If there is a (significant) period between an Initial Assessment and the provision of Services another assessment maybe required. This will be at the discretion of the treating Independent Physiotherapist

Services are provided either on the basis of individual Sessions (see clause 4 for explanation) or a series of Sessions, the best course of treatment will be discussed at your Initial Assessment.

It is not possible that any particular result or outcome can be guaranteed as a result of the provision of Services but we aim to provide such:

 by using reasonable care and skill; and

 Ensuring that they comply with commonly accepted practices, standards and clinical guidelines of the Chartered Society of Physiotherapy.

 Please be aware that the performance of the Services will:

 involve the touching and manipulation of parts of your body;

 require that Independent Physiotherapist may need, on occasion, for you to remove at least some of your clothing; and require that you wear loose-fitting clothing.

3. Where the Services are Provided

Normally the Services will be provided at your home. In order for the Independent Physiotherapist to provide the Services effectively you will need to ensure that the space where the Services are to be performed is ready for use, suitable and has been cleared of obstructions with all appropriate facilities including adequate lighting and heating. You must also ensure the health of safety of our Independent Physiotherapists whilst on your premises.

4. Length of a Session

Services are provided in sessions normally given in 60-minute slots ('Session(s)'). The actual period of the performance of Services during a Session will normally be approximately 5 minutes less. A few minutes at the beginning of each Session is required to set up, ask you any questions about your condition, any issues or problems etc, allowing you time to disrobe etc.

At any time during a Session if in the Independent Physiotherapists’ opinion they consider that: you appear to be unwell or becoming unwell; and/or not following the Independent Physiotherapists reasonable instructions (such as not following instructions intended to protect your, the Independent Physiotherapists or another person's safety); and/or you are behaving or acting unreasonably or are offensive, then the Independent Physiotherapist may wish to stop a Session and not continue it.

 

5. Costs of Sessions and payment

Costs

Our fee for a Session or a block of Sessions (where ordered by you at the same time) are set out at www.specialisedphysio.com.

Session overruns

If, at your request, and with the Independent Physiotherapist’s agreement, a Session runs longer then a Session period you will be charged for each [15] minutes that the Independent Physiotherapist provides you with the Services at the pro-rata rate you are paying for a Session.

Increase in Session costs

If you book a block of Sessions then the fee will remain the same for that block of Sessions if We increase the rate of fees. If you book Sessions one at a time, you will be entering a separate contract at each booking. In this case the fee for each Session will be that in force at the time of the booking.

Payment

SP accepts payment in cash, by cheque or bank transfer. All costs are inclusive of VAT. 

After each session the fee for the session will be invoiced to you by Us. If you have booked a block of Sessions then you will be invoiced for the total fee for the block of Sessions after the first Session in the block.

 

6. Travel Time

To provide the Services at your home SP does not normally charge for travelling to or from a Session

 

7. If you are late for a Session or you cancel

If you are late

If you are late arriving to a Session the Session will start when you arrive. The Session will continue until its scheduled end and you will be charged the full fee for the Session. If you wish the Session to overrun, and the Independent Physiotherapist agrees, then you will be charged for the extra time the Independent Physiotherapist spends in providing the Services, as set out in clause 5.2 above.

If in the Independent Physiotherapists reasonable opinion they consider that providing the Services will serve no practical value or will be unsafe for you in the time available remaining of the Session then the Independent Physiotherapist may cancel the Session. You will still be expected to pay the full fee for the Session however.

If you cancel

If you have booked a single Session and you cancel with less than 48 hours’ notice then you are expected to pay the full fee for that Session. If you cancel a Session when you have booked a block of Sessions with less than 48 hours’ notice then that session will be considered to have taken place and be deducted from the block.

 

8. If the Independent Physiotherapist cancels

On occasion the Independent Physiotherapist may have to cancel a scheduled Session. This may occur for a number of reasons, such as the Independent Physiotherapist is unwell, or a preceding session has overrun or the Independent Physiotherapist cannot reach the location where a scheduled Session is to take place because of travel problems (traffic jams, etc). If a cancellation occurs in this situation then you will be offered another scheduled Session without further charge to you or offered a refund of the fee for that scheduled Session.

 

9. The qualifications and professional memberships of Independent Physiotherapists

The Independent Physiotherapists are qualified physiotherapists and members of the Chartered Society of Physiotherapy. However, the Independent Physiotherapists themselves are independently responsible for their own continuous professional development, maintaining membership of relevant professional bodies (Chartered Society of Physiotherapy, Health Professionals Councils) and maintaining appropriate insurance. The Initial Assessment and treatment program are entirely at the discretion of the Independent Physiotherapist. We are a booking service enabling you to book Services with our Independent Physiotherapists. Whilst we interview and assess their eligibility to provide Services we do not guarantee or warrant and make no representations regarding their reliability, quality or suitability. They maintain their own professional development.

 

10. Transferring booked Sessions

If you have booked (and paid for) Sessions and you would like to allow another person to use the booked Sessions this may occur as long as the other person undertakes an Initial Assessment (in the way outlined under clause 1 above).

 

11. Limitation on the liability of SP and the Independent Physiotherapist to you

Our or the Independent Physiotherapist’s liability to compensate you for any loss or damage (in the case of loss or damage other than death or personal injury) is limited to a reasonable amount having regard to such factors as whether the damage was due to a negligent act or omission by Us or the Independent Physiotherapist. Our or the Independent Physiotherapist’s liability for death or personal injury is also subject to certain limitations which are set in clause 13. As noted above we introduce Independent Physiotherapists but are not liable for the for the fulfilment of any booking or performance of the Independent Physiotherapist.

 

12. Limitation and exclusion of liability for personal injury and death

We or the Independent Physiotherapist will compensate you for any loss or damage you may suffer if We or the Independent Physiotherapist fail to carry out duties imposed on them by law (including causing your death or personal injury by my negligence) unless that failure is attributable to:

12.1       your own fault;

12.2       a third party unconnected with the provision of Services under this contract; or

12.3         events which We or the Independent Physiotherapist could not have foreseen or forestalled     even if all reasonable care had been taken.

12.4         You agree to defend and indemnify us from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees that arise from your misuse of or access to our booking service or breach of any of our Terms.

14. Contracts (Rights of Third Parties) Act 1999

For the purposes of the Contracts (Rights of Third Parties) Act 1999 this agreement is not intended to, and does not, give any person who is not a party to it any right to enforce any of its provisions.

 

15. Intellectual Property

Our name, logo, brand and all other intellectual property rights, trademarks, service marks,    graphics and logos whether registered or unregistered belong to Us and are protected by law and nothing in these Terms grants you any rights in them.

 

16. Disputes

This Agreement shall be construed in accordance with English Law and the Courts of England and Wales shall have exclusive jurisdiction in so far as any matter arising from this Agreement is required to be referred to a court of law
